1. Acceptance of Terms

   By accessing or using EO Care’s websites, mobile applications, products, and services (collectively, the “Services”), including the EO Care store at shop.eo.care, you agree to these Terms of Use (“Terms”) and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility & Age Restrictions

   The Services are intended for individuals 21 years of age or older where required by applicable law. Products on this website are intended only for individuals aged 21 and over. If you are under 21 (or under the age of majority in your jurisdiction), you may not use or purchase from shop.eo.care.

3. Health & Safety; No Medical Advice

   EO Care provides clinically guided, educational content and access to cannabinoid-based symptom-management products. EO Care does not provide medical advice and our products and content are not a substitute for professional medical care.

   - Ensure you follow label instructions when using.

   - Do not use if you are pregnant or nursing.

   - Always consult a physician before using EO Care products or any dietary supplements, especially if you have a medical condition or take medications.

   - These statements have not been evaluated by the FDA. Our products are not intended to diagnose, treat, cure, or prevent any disease.

4. Compliance & Jurisdiction (Hemp-Derived Products)

   EO Care’s online store sells hemp-derived products compliant with federal law (containing Δ9-THC not exceeding 0.3% on a dry-weight basis). Availability may vary by state and local law. You are responsible for ensuring purchases and use comply with your local regulations.

5. Accounts & Security

   You may need an account to access parts of the Services. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use.

6. Orders, Pricing, and Payment (shop.eo.care)

   Placing an order is an offer to buy; EO Care may accept or decline any order. Prices, promotions, and availability are subject to change without notice. We may correct errors or cancel orders that arise from inaccuracies or suspected fraud/abuse.


   
   Applicable taxes and shipping fees will be presented at checkout.

7. Shipping, Risk of Loss, and Returns

   Title and risk of loss pass to you upon delivery by the carrier.


   
   We may offer limited returns/refunds per our Return Policy (incorporated by reference); certain items may be final sale due to safety regulations.

8. Subscriptions & Auto-Renewal (if applicable)

   If you enroll in a subscription:

   - Your plan auto-renews at the then-current price until canceled.

   - We will disclose billing frequency and how to cancel before you enroll.

   - You may cancel any time effective for the next renewal period; partial-period refunds are not guaranteed unless required by law.

9. Acceptable Use & Prohibited Conduct

   You agree not to: (a) use the Services unlawfully; (b) resell, divert, or export products contrary to law; (c) interfere with or disrupt the Services; (d) scrape or reverse-engineer; (e) submit or transmit harmful code; or (f) infringe intellectual property or privacy rights.

10. Intellectual Property

    The Services, including all software, text, graphics, logos, and content, are owned by EO Care or its licensors and protected by IP laws. Except for limited personal use, you may not copy, modify, distribute, or create derivative works without prior written consent.

11. User Content (Reviews, Feedback)

    If you submit content (e.g., reviews, comments, feedback), you grant EO Care a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with the Services. Do not submit content that is unlawful, misleading, or infringes others’ rights.

12. Third-Party Services & Links

    The Services may reference or link to third-party offerings (e.g., pharmacies, payments, logistics). EO Care is not responsible for such third parties and your use is governed by their terms and policies.

13. Privacy & Cookies

    Our Privacy Policy explains how we collect and use information. We use cookies to enhance your browsing experience. See our Cookie Notice for details and controls.

14. Product Information & Testing

    EO Care strives for accurate product descriptions (e.g., cannabinoid content, ingredients). Actual effects vary by individual. Lab results and COAs may be provided or referenced where available; minor variances can occur within legal limits.

15. Disclaimer of Warranties

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, including merchantability, fitness for a particular purpose, title, and non-infringement. EO Care does not warrant that the Services will be uninterrupted, secure, or error-free.

16. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, EO CARE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, or for lost profits, revenues, data, or use, arising from or related to the Services or products, even if advised of the possibility. In all cases, EO Care’s total liability shall not exceed the amount you paid to EO Care for the product(s) giving rise to the claim in the 6 months preceding the claim.

17. Indemnification

    You agree to defend, indemnify, and hold harmless EO Care and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your misuse of the Services or violation of these Terms or applicable law.

18. Regulatory Notices

    - FDA Notice: Statements on the Services have not been evaluated by the FDA. Products are not intended to diagnose, treat, cure, or prevent any disease.

    - Safety: Do not use EO Care products if pregnant or nursing. Consult a physician before use. Follow label instructions.

19. Governing Law; Venue

    These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Subject to Section 20 (Arbitration), you agree to exclusive jurisdiction in state and federal courts located in Suffolk County, Massachusetts.

20. Dispute Resolution; Arbitration; Class-Action Waiver

    PLEASE READ THIS CAREFULLY:
Except for small-claims matters, any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration on an individual basis administered by a recognized arbitral forum. YOU AND EO CARE WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION. Nothing in this section prevents either party from seeking injunctive or equitable relief in court for IP or data-security matters.

21. Changes to the Services or Terms

    We may modify the Services and these Terms at any time. Material changes will be posted with an updated Effective Date. Continued use after changes constitutes acceptance.

22. Termination

    We may suspend or terminate access to the Services at any time for any reason, including suspected violations of these Terms or applicable law. Upon termination, provisions that by their nature should survive will survive (e.g., IP, disclaimers, limitation of liability).
